We're here to support you in any way possible, including ad creation for your agency. With the fluctuation in rate changes, your diligence with reviewing your current ads is imperative and appreciated.

Please read the note below from GBU's Compliance Team regarding ads which reference GBU's logo, rates, product names, etc.

The use of outdated ads is prohibited by GBU. To ensure that GBU remains compliant with advertising regulations, all ad pieces must be submitted to GBU’s Marketing team prior to use at communications@gbu.org .

Advertisements for life and annuity products are governed by the ADVERTISEMENTS OF LIFE INSURANCE AND ANNUITIES MODEL REGULATION. Notwithstanding a few states with state-specific requirements, the Model regulation provides the framework for insurers to use as a guideline to ensure advertisement compliance.

The risk of circulating outdated ads may result in inaccurate information which can be misleading to a consumer. Section 4 of the Model regulation provides in part the following:

Advertisements shall be truthful and not misleading in fact or by implication. The form and content of an advertisement of a policy shall be sufficiently complete and clear so as to avoid deception. It shall not have the capacity or tendency to mislead or deceive.

The Model regulation also requires advertisements to include appropriate disclosures which are unique depending on the product advertised. In addition, there are prohibitions to the use of certain words or phrases to be used in an advertisement which is also outlined in Section 4:

No advertisement shall use terms “investment,” “Investment plan,” “founder’s plan,” “charter plan,” “deposit,” “expansion plan,” “profits,” “profit sharing,” “interest plan,” “savings,” “savings plan,” “private pension plan,” “retirement plan” or other similar terms in connection with a policy in a context or under such circumstances or conditions as to have the capacity or tendency to mislead a purchaser or prospective purchaser of such policy to believe that he will receive, or that it is possible that he will receive, something other than a policy or some benefit not available to other persons of the same class and equal expectation of life.

To ensure all ads capture these requirements, they must be reviewed for accuracy. Marketing partners with GBU’s Compliance Department to ensure that we are fulfilling our regulatory requirements within each state GBU conduct business. Non-compliance can lead to consumer complaints and fines by the state’s department of insurance.
